StudyMind Terms of Use

Effective date: 1 October 2026 · Last updated: 1 October 2026 · Version 1.1 · Provider: TX Fintech Ltd, DIFC Reg. No. CL7465 · Contact: support@txfintech.com

1. About these Terms

These Terms of Use (the “Terms”) govern your use of StudyMind, the mobile app that helps you explore what and where to study, and the related website and services offered under the StudyMind name (together, the “Services”).

The Services are owned and operated by TX Fintech Ltd, DIFC Registration No. CL7465, Dubai International Financial Centre (DIFC), P.O. Box 418630, Dubai, United Arab Emirates (“TX Fintech”, “we”, “us” or “our”).

These Terms are a binding agreement between you and TX Fintech. You accept them when you create a StudyMind account. If you do not agree, do not create an account or use the Services.

Please read these Terms together with the StudyMind Privacy Policy and the purchase terms shown in the app store when you buy.

1.1 Definitions

“Applicable Law” means any law, regulation or binding rule that applies to you, to TX Fintech or to the relevant use of the Services. “Applicable Consumer Law” means the consumer-protection law that applies to you as a consumer, including the mandatory rules of the country where you habitually live. “Applicable Data Protection Law”, “Personal Data” and “Sensitive Personal Data” have the meanings given in the Privacy Policy. “Free Plan”, “Paid Plan” and “User Content” are defined in sections 18 and 12.

2. Eligibility

You must be at least 16 years old to create a StudyMind account or use the Services. By creating an account you confirm that you are at least 16, that you have the legal capacity Applicable Law requires to accept these Terms, and that Applicable Law does not prohibit your use of the Services.

If you are 16 or 17, the law where you live may give you extra protection as a minor. If that law requires a parent's or guardian's consent for you to make a purchase, you may buy a Paid Plan only with that consent. Purchases are made through your Apple or Google account, and family purchase controls set by a parent apply.

If we learn that an account belongs to someone under 16, we will close it and delete its data.

3. Your StudyMind account

You can create an account with your email address and a password (we confirm the address with a code sent by email), or with Sign in with Apple or Google sign-in. Please give accurate information and keep your password secure.

You must not share your account with others, let another person impersonate you, use someone else's account without permission, or try to get around sign-in or account-security measures. You are responsible for activity in your account, unless it results from our failure to take reasonable security measures or from circumstances you are not legally responsible for.

If you think someone has used your account without permission, tell us straight away at support@txfintech.com. We may ask for extra verification where reasonably needed to protect you, other users or the Services.

4. What StudyMind does

StudyMind helps you explore which fields of study and which university programmes may suit you. Depending on your plan, the Services include:

  1. three assessments, called Interests, Motivation and Personality, in which you answer statements with Yes/No or on a scale;
  2. an orientation questionnaire about your situation and preferences, such as your home city, citizenship, languages, yearly study budget, preferred countries and field of study;
  3. matches between your profile and university programmes, with a match score, calculated with statistical methods;
  4. written explanations of your assessment results, a profile summary and other texts created with artificial intelligence (section 5);
  5. a personal report that you can download as a PDF;
  6. a searchable database of universities and programmes, favourites and programme comparison.

What each plan includes is described in section 18 and shown in the app before you buy. Features the app marks as “coming soon” are not part of any plan until they are released.

StudyMind is available in English only. We may improve, change or remove individual features in line with section 25 and Applicable Law.

5. Artificial intelligence

Some StudyMind texts are written with artificial intelligence supplied by OpenAI: the explanations of your assessment results, your profile summary, the field comparison in your report, and travel information between your home city and a university's city. The matching itself is done with statistics, not with AI.

Before any of your data is sent to OpenAI, the app asks for your permission and explains what is sent. The Privacy Policy describes this processing in full. You can withdraw your permission at any time in Settings → Privacy & Data. StudyMind cannot explain your results without AI, so after withdrawing you can allow it again or delete your account.

AI-generated text can be inaccurate or incomplete, can misread context, and can differ between two requests with the same information. Check anything important before you rely on it.

6. Assessments, results and matches

StudyMind results, scores, matches and explanations are produced from the answers and preferences you give, our assessment methods and software, and for some texts AI. They are meant to support your reflection and your decisions about studying. They do not guarantee academic performance, admission to any institution, eligibility for a programme or scholarship, employment, income or any other outcome.

The decisions about your studies remain yours. For important decisions, also use information from the institutions themselves and, where appropriate, advice from teachers, school counsellors or career advisers.

7. Educational purpose only, no clinical or diagnostic use

StudyMind is an educational guidance service. It is not a medical, psychological, psychiatric or clinical service. The Personality and Motivation assessments describe preferences for study purposes; they are not a psychological evaluation and do not diagnose, treat or prevent any medical, psychological, behavioural or learning condition.

StudyMind results and AI-generated texts are not medical or psychological advice and are not a substitute for an assessment by a qualified professional. If you are in distress or need urgent help, contact your local emergency services or a qualified professional.

8. Not for decisions about other people

StudyMind results are about you and for you. They are not designed to be used by anyone else as the sole basis of a decision about you, for example about admission, employment, credit, insurance or medical treatment. Schools, universities, employers and other organisations must not use StudyMind results that way.

9. Your responsibility for how you use results

You decide whether a StudyMind result or text suits what you want to use it for, and you should check important information independently. Do not present an AI-generated text as verified professional advice, and do not use StudyMind outputs in an unlawful or misleading way. Nothing in this section excludes a responsibility that TX Fintech cannot lawfully exclude.

10. Acceptable use

You may use StudyMind only for lawful purposes and in line with these Terms. You must not use or try to use the Services:

  1. in breach of Applicable Law or another person's rights;
  2. to impersonate another person or to use another person's account without permission;
  3. to introduce malware or other harmful code, or to interfere with the integrity, availability, performance or security of the Services;
  4. to probe, scan or test vulnerabilities without our written authorisation, or to bypass technical, security, usage or access restrictions, including purchase checks and plan limits;
  5. to scrape, harvest or systematically extract data, or to access the Services by automated means we have not authorised, except where the law expressly permits it and it cannot be restricted by contract;
  6. to reverse engineer, decompile or disassemble the Services, except to the extent Applicable Law expressly permits it despite this restriction;
  7. to build a competing service by reproducing protected parts of StudyMind, or to use StudyMind assessments, content or outputs to train or improve an artificial-intelligence model, except where Applicable Law expressly permits it;
  8. to commit fraud, abuse or harassment; or
  9. to help another person break these Terms.

We may use proportionate technical measures to protect the Services against abuse, such as limits on how many sign-in attempts or requests can be made in a period of time.

11. Academic integrity

StudyMind is meant to help you think about your studies, not to help with coursework or examinations. You remain responsible for following the rules of your school or university on the use of AI and educational technology.

12. Your content

“User Content” means what you enter in the Services beyond your account details: mainly your answers to the assessments and the study preferences you set (for example countries, languages and budget).

You keep any rights you hold in your User Content. You give TX Fintech a non-exclusive, worldwide, royalty-free licence to host, copy, process and transmit it only as far as needed to provide the Services and the outputs you ask for, to operate and secure the Services, to provide support, to comply with Applicable Law and to establish or defend legal claims.

This licence does not transfer ownership of your User Content and does not allow TX Fintech, or the AI provider we use, to train general-purpose AI models on it. The licence ends when your User Content is erased from the Services, except for copies we may keep as described in the Privacy Policy (for example short-lived backups).

You confirm that you have the right to submit your User Content. Please do not enter information about other people, or sensitive information about yourself that the Services do not ask for.

13. StudyMind intellectual property and your licence

Except for User Content and third-party material, the Services and their content are owned by or licensed to TX Fintech. This includes the software, design, user interface, databases, assessment structures, methodology, reports and report formats, text, graphics, the StudyMind name and logo, and documentation.

Subject to these Terms, TX Fintech gives you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable right to use the Services for their intended purpose. For the mobile app, this right covers devices you own or control, subject also to the rules of the app store you got it from. No other intellectual-property right passes to you.

14. Outputs

Subject to Applicable Law and third-party rights, you may use your StudyMind results and reports for your own personal, non-commercial purposes, including sharing them with your family, teachers or advisers.

AI-generated text is not necessarily unique: other users may receive similar text. TX Fintech does not promise that an AI-generated output is unique, capable of exclusive ownership or free of third-party rights.

15. Feedback

If you send us suggestions or feedback about StudyMind, you allow TX Fintech to use them to develop and improve the Services without paying you. Any Personal Data in your feedback stays subject to the Privacy Policy.

16. Third-party services and information

StudyMind relies on outside services, including cloud hosting, AI, sign-in, email, app distribution and payment services. They may have their own terms and privacy policies. TX Fintech is not responsible for an independently operated third-party service where the matter is outside its reasonable control. Nothing in this section excludes responsibility that cannot lawfully be excluded.

16.1 University and programme information

StudyMind shows information about universities and study programmes, such as programme names, locations, languages of instruction and tuition fees. This information is compiled from public sources, including the institutions' own websites, and may be incomplete, out of date or changed by the institution at any time. StudyMind is not affiliated with, endorsed by or acting for any university shown in the app, and showing a programme is not an offer of a place. Before you apply, check admission requirements, deadlines and fees with the institution itself. Links to university websites open outside StudyMind, in your browser.

17. App stores

You get StudyMind from the Apple App Store or Google Play, and you buy Paid Plans through them. Your use of the store is also governed by the store's own terms. The store processes your payment, keeps your purchase records, restores purchases to your device and handles refund requests under its rules. These Terms govern your relationship with TX Fintech about StudyMind itself, subject to the store's rules and Applicable Law.

17.1 Additional terms for the Apple App Store

If you got StudyMind from the Apple App Store, the following also applies:

  1. These Terms are between you and TX Fintech, not Apple. TX Fintech, not Apple, is solely responsible for StudyMind and its content.
  2. Your licence is limited to a non-transferable licence to use StudyMind on Apple-branded products that you own or control, as allowed by the Usage Rules in the Apple Media Services Terms and Conditions, including use through Family Sharing where Apple provides it.
  3. Apple has no obligation to provide maintenance or support for StudyMind. TX Fintech provides support as described in section 45.
  4. To the extent the law allows, Apple has no warranty obligation for StudyMind. If StudyMind fails to conform to an applicable warranty, you may tell Apple, and Apple may refund the purchase price you paid for it; Apple has no other warranty obligation for StudyMind.
  5. TX Fintech, not Apple, is responsible for any claims relating to StudyMind or your use of it, including product-liability claims, claims that StudyMind fails to meet a legal or regulatory requirement, and claims under consumer-protection, privacy or similar laws.
  6. If a third party claims that StudyMind or your use of it infringes their intellectual-property rights, TX Fintech, not Apple, is responsible for investigating, defending, settling and discharging the claim.
  7. You confirm that you are not in a country subject to a US Government embargo or designated by the US Government as supporting terrorism, and that you are not on any US Government list of prohibited or restricted parties.
  8. You must comply with any applicable third-party terms when using StudyMind.
  9. Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, may enforce them against you.

18. Plans and one-time purchases

StudyMind has a Free Plan and three Paid Plans. Each Paid Plan includes everything in the plans below it.

Plan What it includes
Free The Interests assessment and a sample report
Starter All three assessments (Interests, Motivation, Personality) and your full personal report. The report shows five example universities, not universities matched to you.
Premium Everything in Starter, plus your 5 best-matched universities with programme details, comparing programmes, and saving favourites
Unlimited Everything in Premium, plus 10 matched universities in total and the University Finder database of universities and programmes

Each Paid Plan is a one-time purchase. It is not a subscription: it does not renew and you are never charged again for it. If you already have a lower plan and buy a higher one, you pay the full price of the higher plan, unless the app offers a lower upgrade price at that time.

Before you buy, the app and the store show you the plan, what it includes and its price. Those purchase terms form part of these Terms.

A Paid Plan gives you access to its features for as long as your account exists and StudyMind is provided.

We may change which features are free or paid, but only for the future: a change never takes away a feature of a plan you have already bought, except where the law requires it or for compelling security or legal reasons, in which case section 25 applies.

19. Your plan and your account

After the store confirms your payment, we check the purchase with Apple or Google and unlock the plan on the StudyMind account you were signed in to when you bought it. The plan stays linked to that StudyMind account and to the Apple ID or Google account you paid with.

On a new phone, sign in to the same StudyMind account and tap Restore Purchases. A purchase cannot be moved to a different StudyMind account. If you delete your StudyMind account, your plan ends with it and cannot be restored on a new account.

20. Delivery

Your plan is unlocked as soon as the store confirms the purchase and we have checked it. Your full personal report is created once you have completed all three assessments, and can be downloaded from the dashboard.

21. Refunds and withdrawal

Refunds are handled by the store you paid: Apple for App Store purchases, Google for Google Play purchases, under their refund rules. TX Fintech cannot refund App Store purchases itself. Google may pass some Google Play refund requests to us, and we handle those in line with Applicable Consumer Law. If a purchase is refunded, the plan it unlocked is removed from your account, and given back if the store reverses the refund.

Nothing in these Terms excludes or limits your statutory rights, including any right to a refund, price reduction or withdrawal under Applicable Consumer Law. There is no general “no refunds” rule.

22. Promotions

We may offer promotional prices or free access from time to time. The conditions will be shown with the offer. Promotional access ends when the promotion ends unless the offer says otherwise.

23. Prices and taxes

The price of a Paid Plan is the price shown in the App Store or Google Play when you buy, in your local currency and including any taxes the store must charge. Apple and Google set the currency conversion and collect the taxes. We may change prices for future purchases; a price change never affects a purchase you have already made.

24. Privacy

The StudyMind Privacy Policy explains how we handle your personal data: what we collect, why, the AI processing by OpenAI, our service providers, international transfers, how long we keep data, the protection of younger users and your rights. These Terms do not limit your rights under data protection law.

25. Changes to the Services

We may add, improve, change or remove features to improve StudyMind, fix security or technical problems, comply with the law, respond to changes by our providers or the app stores, or prevent abuse. A change will not take away a feature of a Paid Plan you have already bought unless the law requires it or there are compelling security, legal or technical reasons. If a change materially and negatively affects a Paid Plan you bought, we will tell you in advance and give you the remedies Applicable Consumer Law provides, such as ending the contract or a refund or price reduction.

26. Availability

We aim to keep StudyMind available but cannot promise that it will always work without interruption or errors. It may be unavailable during maintenance, updates, provider or network failures, security incidents or other events. We will try to keep disruptions short. This does not affect your rights if a Paid Plan is not provided in line with Applicable Consumer Law.

27. Suspension

We may restrict or suspend your access where reasonably necessary because you have materially broken these Terms, your account poses a security risk, we reasonably suspect fraud or unlawful activity, a payment for the relevant Paid Plan has been reversed or appears fraudulent, or the law or an authority requires it. Where appropriate and lawful, we will tell you first and give you a chance to fix the problem; we may act at once where needed to stop fraud, a security threat or serious abuse.

28. Ending your account

You can stop using StudyMind at any time, and you can delete your account in the app (Settings → Privacy & Data → Delete My Account) or by writing to support@txfintech.com. Your account closes as soon as you confirm in the app, or once we have checked a request sent by email, and is erased 30 days later, as described in the Privacy Policy and on studymind.me/delete-account.

Deleting your account ends your access to everything in it, including any Paid Plan you bought, and a purchase cannot be restored on a new account afterwards. Download your report first if you want to keep it. Where Applicable Law gives you a right to a refund or another remedy, that right still applies.

We may close your account if you materially or repeatedly break these Terms, as allowed by Applicable Law. When your account ends, your right to use StudyMind ends, provisions meant to survive (such as sections 29 to 46) continue to apply, and your personal data is handled as the Privacy Policy describes.

29. Warranties and statutory rights

TX Fintech will provide the Services with the care and skill required by Applicable Law. Because StudyMind uses complex software, outside technology and AI, we do not promise that every output will be accurate, complete or suitable for every purpose. To the extent Applicable Law allows, and always subject to your mandatory consumer rights, TX Fintech gives no warranties beyond those in these Terms or required by law. Nothing in these Terms excludes or restricts a warranty, right or remedy that cannot lawfully be excluded or restricted.

30. Limitation of liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud or fraudulent misrepresentation, and for death or personal injury caused by negligence.

Subject to that, TX Fintech is not liable for losses that were not reasonably foreseeable when you accepted these Terms, or that result from events outside its reasonable control, unless Applicable Law says otherwise. If you use StudyMind as a consumer, nothing in these Terms limits TX Fintech's liability for failing to provide the Services in line with your mandatory consumer rights.

If you use StudyMind for business or professional purposes, then, unless a separate agreement says otherwise, TX Fintech's total liability under these Terms is limited to the greater of the amount you paid TX Fintech for the Services in the 12 months before the event giving rise to the claim and USD 100, and TX Fintech is not liable for loss of profit, revenue, business, goodwill or anticipated savings, or for indirect or consequential loss.

31. Indemnity for unlawful business use

This section does not apply to you as a consumer to the extent such an indemnity would be prohibited or unfair under Applicable Law. If you use the Services for a business, institution or profession, you are responsible, to the extent Applicable Law allows, for third-party claims arising directly from your unlawful use of the Services, content you had no right to submit, your material breach of these Terms or your infringement of another person's rights. This does not cover losses caused by TX Fintech's own breach, negligence or wilful misconduct.

32. Events outside our control

TX Fintech is not responsible for delay or failure to perform to the extent it is caused by events beyond its reasonable control, such as major telecommunications or cloud-service failures, natural disasters, war, civil disorder, government action, sanctions, epidemics or cyberattacks. This does not affect your mandatory rights or obligations that Applicable Law requires us to perform regardless.

33. Mandatory consumer rights

If you use StudyMind wholly or mainly outside your trade, business, craft or profession, you may have mandatory rights under the consumer laws of the country where you live. These Terms do not exclude, restrict or waive those rights. If a provision of these Terms conflicts with a mandatory consumer rule that applies to you, the mandatory rule prevails.

34. Governing law

Subject to section 33, these Terms and any non-contractual obligations connected with them are governed by the laws of the Dubai International Financial Centre (DIFC). If you are a consumer, you keep the protection of the mandatory laws of the country where you habitually live.

35. Jurisdiction and disputes

If you have a complaint, please contact us first so that we can try to resolve it. Subject to consumers' mandatory rights, the DIFC Courts have jurisdiction over disputes arising from these Terms or the Services. If you are a consumer, you may also bring proceedings in the courts of the country where you habitually live, or another court where Applicable Law gives you that right. These Terms do not require a consumer to take a future dispute to arbitration. After a dispute arises, both sides remain free to agree to mediation or another lawful form of alternative dispute resolution.

36. Complaints

You can send questions or complaints to the contact details in section 45. We will acknowledge complaints promptly and consider them fairly within a reasonable time. Nothing in these Terms stops you from going to a consumer dispute-resolution body, regulator, ombudsman or other authority where Applicable Law gives you that right.

37. Institutional use

Schools, universities, employers and other organisations can obtain access to StudyMind only under a separate written agreement with TX Fintech. If such an agreement conflicts with these Terms on a matter it covers, the agreement governs that matter, subject to the mandatory rights of individual users.

38. Third-party beneficiaries

Except for Apple and its subsidiaries as stated in section 17.1, or where Applicable Law or app-store terms expressly say otherwise, no one who is not a party to these Terms has a right to enforce them.

39. Assignment

You may not transfer your rights or obligations under these Terms without our consent, unless Applicable Law gives you a right to do so. TX Fintech may transfer these Terms as part of a merger, restructuring, financing or sale of its business or assets, provided this does not reduce your mandatory rights, and will give any notice or obtain any consent the law requires.

40. Severability

If a provision of these Terms is found unlawful, invalid or unenforceable, it applies to the maximum extent allowed or, if necessary, is removed. The rest of the Terms stays in effect.

41. No waiver

If TX Fintech does not exercise a right straight away, it has not given that right up. A waiver of one breach is not a waiver of any other breach.

42. Entire agreement

These Terms, together with the purchase terms shown at the point of purchase and any terms expressly included in them, are the whole agreement between you and TX Fintech about your use of StudyMind. The Privacy Policy explains how we handle Personal Data and should be read alongside these Terms. Nothing in this section excludes liability for fraud or restricts mandatory consumer rights.

43. Changes to these Terms

TX Fintech may update these Terms when reasonably needed to reflect changes to the Services, the law, regulatory or security requirements, or outside technology and services. The “Last updated” date shows the current version. If a change materially affects your rights or obligations, we will tell you in the app or by email before it takes effect. Where Applicable Law requires your consent to a change, continuing to use the Services does not count as consent. Changes never alter the terms of a purchase you have already completed, unless the law requires it.

44. Language

These Terms are written in English. If we provide a translation and the law where you live requires a particular language version to prevail, that version prevails to the extent required.

45. Contact

46. Final provisions

These Terms are meant to set a fair framework for using StudyMind while keeping every right that cannot lawfully be excluded or restricted. Nothing in them excludes mandatory consumer rights, limits your data-protection rights, turns educational or AI-generated outputs into professional, clinical or diagnostic advice, or asks you to waive a right that cannot be waived.
